Kibale Forest National Park

Essential Aspects You Need to Know Before You Buy Land

Every young professional in Uganda today dreams of buying and owning land. It is sometimes considered as the epitome of success. The skeptics are many and to some the gruesome stories of the bad experiences in land transactions are a turn off. The fear of the unknown overcomes the benefit of the risk in buying and owning property.

The question on many people’s minds and the reason they part with hefty sums to lawyers is, WHAT DO I NEED TO KNOW BEFORE I BUY LAND?

Ian Mutibwa, an Advocate and Tax consultant, shared with us a few tips on what one should consider before parting with money and venturing into land transactions in Uganda.

Know what type of land you are purchasing

Many people do not differentiate titled from untitled land, mailo and freehold interest. Some people go ahead and part with money to buy untitled land and end up sometimes paying double for it. Most untitled land is customary land or Kibanja land. This means two things, first where it is customary land, it is usually communally owned and one needs to seek permission of the clan or village head before they sell off the community land. Where the land is a Kibanja, one needs to ask the Kibanja holder whether they have duly purchased the same from the registered owner and also request to meet the registered owner of the said property.

Carry out a search at the Lands registry where the land is registered

It is important that you carry out a formal search at the Lands registry. The location of the land determines which registry you carry out the search from. It is important at this stage to engage a lawyer who shall enable you carry out the search. You shall receive a search letter, which clearly shows the content of the title at the Lands registry. The search shall contain details of the registered land, names of the registered owner, size of the land, location, encumbrance (if any) for example, mortgage, lease, caveat etc.

Carry out a search at the land itself (Locus)

The search at the lands office is not conclusive, as it may not indicate what is physically on the land. The land may have plantations, graves, houses, and other tenants. It is therefore important that one visits that land in question before they make up their minds to fully purchase the land.

Visit the local council and police station

In addition to visiting the land itself, it is important to see the local council of the area where you are going to buy the land. The local council usually knows the people in the area and where the person is not the right person, the LC shall advise. Usually it is important to visit the local council with the intended sellers of the land and have a written confirmation from the LC that these are indeed the owners of the land you intend to buy.

Police visit

There may be some disagreements on the land that may not be physical. These may be disagreement with siblings, parents and children and neighbors. These are usually reported to the police. The Police should have records of these disputes. It is important to know of these disputes because you do not want to be in a situation where you purchase land from one brother and are chased off the land by another brother who did not consent. The police shall provide ample evidence of these disputes.

Draft a land sale agreement

I would argue all persons buying land to engage the services of a lawyer to draft the land sale agreement. This is because there are many clauses that one may not envisage and may need to be protected in their purchase. A well-drafted agreement protects both the buyer and the seller.

After transfer of property, do something on the land.

Where the agreement is finalized and the purchase is done and the transfer has been finalized, most purchasers lay back and relax with their titled secured. This is one of the biggest mistakes many people make and consequently end up losing their land to squatters or find their land sold off.

Ian Mutibwa added “It is important that you protect your interests. Lodge a caveat on the land after registering a proprietor. This caveat helps in as far as one is notified when there is a transaction that is happening on the land.”

For some time now, I have been hearing about sexual dissatisfaction among young couples. Men complain that their spouses are not sexually attracted to them or women are saying their boyfriends or fiancés were just not interested in sex or had no desire for them.

How to Acquire a Mortgage For Your Property

Securing a mortgage can be an overwhelming process. With the fluctuation of the dollar rate in the past year banks have been forced to maintain a high interest rate in order not to acquire many losses and this has also led to many people staying away from mortgages. Shakib Nsubuga, Country Manager of Lamudi in Uganda, said: “ Last year we saw interest rates as high as 24 percent but this year we hope to see them go as low as 16 percent and this will hopefully be beneficial for both the banking and real estate sector”

According to the Housing Finance Bank, loan sizes must be a minimum of five million shillings depending on the property, location and value. The loan available should not exceed 70 percent if constructing a residential property, 80 percent for purchase of property within Kampala and 30 million shillings for a continuing house loan.

It is crucial that you make sure that your loan purpose is clear before you go to a bank or financial institution to request for a loan. The loan purpose could be construction, purchase, extension or improvement of residential and commercial properties, as well as the purchase of a plot.

For the bank to ensure that the mortgage is affordable, the monthly repayment amount should not exceed more than 35 percent of your income. Where income is not sufficient, security or collateral may be required and the bank will confirm income from your stated employer. Self-employed borrowers are usually required to submit proper identification, audited accounts for at least the last two financial years, a Memorandum of Understanding and Articles of Association, Certificate of Incorporation and their company’s returns.

The property that you wish to purchase must also have a valid land title and building plans with approval from Kampala Capital City Authority if it is within Kampala. Construction must be serviced with water or plans for installation must be in place.

Repayment of mortgages usually should not take more than 20 years for residential and commercial properties. The interest rate on all mortgages in Uganda depends on current economic conditions and the central bank rate set by the Bank of Uganda. Many banks in Uganda will insure the mortgage for you at a fee should you be unable to pay off the loan within the given period of time.

It is also important to know that banks do not provide mortgages for land however you can acquire a salary loan from the bank and then use it to buy the land.

Why is Gorilla Trekking Expensive?

Ever thought of planning a gorilla safari to Uganda or Rwanda and stopped along way wondering why gorilla trekking is so expensive? Well, you are not just alone. Many people have been turned off from their dream of trekking the gorillas due to the cost of the gorilla permits and the entire tour costs. For example, in Rwanda, gorilla permits costs US$1500 whereas in Uganda, the gorilla permits are sold at a minimal fee of US$700.00.

Such a high price for the permits makes the gorilla trekking safari to be the most expensive safari holiday experience in Africa. Many travelers have taken part in this amazing life-changing encounter with the gorillas while others continue to plan their gorilla tours for the nearing future. The Mountain Gorillas are highly endangered

One of the top reasons as to why gorilla trekking is so expensive in Rwanda or Uganda is that the gorillas are highly endangered and therefore requires the authorities to reduce their interaction with big crowds of people. According to recent statistics as of 2016, it is estimated that only 1000 mountain gorillas are remaining in the whole world surviving in the tropical rain forests of Bwindi Forest national park and Mgahinga gorilla national park in Uganda, Volcanoes national park in Rwanda and Virunga National Park in the Democratic Republic of Congo. Therefore, this calls for a high cost of the gorilla permits to perhaps discourage some people from traveling hence saving the highly endangered species from the crowds.

Mountain Gorillas Susceptible to Human Diseases

Another reason perhaps is that the mountain gorillas are close relatives to human beings which makes them vulnerable to being infected by human diseases. This means, to save the mountain gorillas from being overcrowded by many humans, the permits have to be put on a high so as to limit some people from trekking them and also to avoid over-exploitation and exceeding the carrying capacity of gorilla national parks, which are Volcanoes National Park, Virunga national park, Bwindi impenetrable national park and Mgahinga gorilla national park.

The need to conserve and offer sustainable gorilla tourism

After experiencing a great loss of mountain gorillas in the 1980s due to poaching and human encroachment on the mountain gorilla habitats. The authorities decided to increase the gorilla permits in both countries so as to accrue revenue which can then be used to conserve the gorilla habitats and also to promote a sustainable gorilla tourism environment. This tells why Rwanda, for example, doubled the gorilla permit fee from $750.00 USD in 2017 to US$1500 aiming to conserve the shrinking habitat of mountain gorillas. Uganda too increased her gorilla permits from US$450 to the current price of US$600. To the Wildlife Authorities Conserving the gorilla is an indirect way of promoting sustainable gorilla tourism in Uganda, Rwanda, and DR Congo. Imagine if there was no limit on the number of travelers allowed to trek mountain gorillas? There would be crowding and overstepping which destroy gorilla habitats. A high number of travelers also make mountain gorillas uncomfortable in their natural habitat, which destructs their social happy life.

Safety and Easy Monitoring

Being that the mountain gorillas are highly endangered species, it is necessary to continuously monitor them so as to ensure they are safe which may not be possible if too many people are allowed to visit their habitats. According to the authorities, the funds collected from selling gorilla permits are partially used remunerate the ranger guides who monitor the wellbeing of mountain gorillas in their habitats such as tracking their movements, feeding, and health status. Tourism police and other armed rangers have also been hired to ensure the safety of mountain gorillas from any external attack by the poachers, and rebel groups who in the past used the gorilla habits as their hiding places. Incase travelers are connecting from one destination to another at night; tourism police escort them which ensures their safety throughout.

Gorilla Trekking is one way of improving the livelihood of the locals

Gorilla tourism has become an indirect source of Local livelihood for the communities adjacent to gorilla national parks. Responsible governments share part of the revenue earned to local communities to improve their standards of living. In Uganda, local people are given 20% of the total revenue earned from gorilla permits while Rwanda gives 10% to local people. Sharing with local people has created a positive attitude of local people towards gorilla tourism and conservation hence reducing the natural resource conflicts between local people and the management of respective national parks. Before the introduction of gorilla tourism and wildlife conservation, local people had full access to all resources in the forest.

PLEASE NOTE: In order to create a peaceful, enjoyable and memorable encounter with these highly endangered species in their natural habitats, travelers are required to follow the gorilla trekking rules and regulations: These include dressing smart for the jungle, keeping a distance and keeping within their groups. The do’s and don’ts are similar in Uganda, Rwanda and Democratic Republic of Congo.

How to behave with mountain gorillas

Mountain gorillas are shy and calm creatures that stay peaceful even in the presence of travelers. You are therefore reminded not to disturb these animals in any way. All travelers must not come so close to gorillas, which disrupt and make them uncomfortable. Also, don not feed gorillas touch them to avoid the spread of human-wildlife communicable diseases. Incase gorillas approach you, you are reminded to step back and let it pass. Travelers are also required to speak at a low tone and keep within their groups not to wander in the forest, which can be harmful.

British Tourist Drowns in River Nile

The Uganda Police Marine Unit with the help of swimmers from Uganda Wildlife Authority are searching for the body of a British tourist who drowned in River Nile on Wednesday evening.
The tourist, identified as Robert Kews, hails from Birmingham in UK. He drowned while swimming in the restricted part of the River Nile in Pakwach District.

The senior warden in charge of community conservation in Murchison falls national park Wilson Kagoro, confirmed the incident, describing it as unfortunate.

“He entered the waters to swim against the caution prohibiting swimming in the river section outside the Murchison Falls National Park,” Kagoro said in a telephone interview. He said that even when warned, the tourist insisted on swimming.

Kagoro added that the deceased alongside three others were being accommodated at Gipir and Labongo Lodge in Pakwach town.

A search for his body has commenced.
